When an individual dies in Florida, probate proceedings are often required to validate the person’s will, process the estate, and carry out the individual’s final wishes. About Probate

Several tasks must be accomplished in probate before the estate can be closed. For example, the deceased person’s will must be validated, debts must be paid, and the remaining estate assets must be distributed to heirs. In most cases, a personal representative will be appointed by the court to oversee the estate. The individual appointed may be named in the deceased person’s will or determined by the court itself.


When someone dies without a will, the process can be more complicated. All of the same tasks will be completed, but they will be carried out based on state law instead of the deceased person’s instructions.
