A Bench warrant is issued by the judge because an individual failed to appear before the court when he or she was required to. Most often, a bench warrant is issued when an individual fails to appear at arraignment (criminal charges are officially filed and announced) and has not hired an attorney. An Alias Capias is similar to a bench warrant; an Alias Capias is usually issued by a felony judge whereas bench warrants are issued by county court judges.
